Terms of Service

1. Agreement

These Terms of Service ("Terms") are a contract between you and DigitalDShop, a brand of SageMarketing Pro ("we", "us"). They apply when you use digitaldshop.com/vice-kit (the "Site") or buy or use VICE KIT, Vice Clipper or the Creator Suite bundles (the "Products"). By using the Site or buying a Product you agree to these Terms, our Privacy Policy and our Refund Policy. You must be at least 18, or the age of majority where you live, or have a parent's or guardian's permission.

2. The products

VICE KIT is a downloadable creator toolkit: a desktop app for Windows and macOS, a browser edition, and design templates and assets (stream overlays, alerts, thumbnail and social templates, channel kits, guides and planners), depending on the plan you choose (Starter, Pro or Ultimate). The Creator Suite bundles add a lifetime license to Vice Clipper. What each plan includes is described on the sales page and checkout page at the time you buy.

System requirements. The desktop app runs on Windows 10/11 (64-bit) and macOS (Apple Silicon or Intel). The browser edition runs in a current version of Chrome, Edge, Safari or Firefox. Because the app is not yet signed with a paid developer certificate, Windows or macOS may show a security warning on first launch; the install guide explains how to open it. Some templates are designed to be edited in third-party tools (such as Canva, OBS Studio or CapCut), which have their own terms and may require their own accounts.

3. Your license

When you pay, we grant you a lifetime, non-exclusive, non-transferable license for one person (or one channel/brand) to:

• install and use the app on your own computers;
• use and edit the templates and assets to create your own content, overlays, thumbnails, posts and channel art; and
• publish that content, including on monetized channels and for sponsored content.

You may not: resell, share, sublicense, give away or redistribute the Products, files, templates or assets (edited or unedited) as templates, packs, presets or stock; upload them to marketplaces or file-sharing sites; share your download links or account; use them to build a competing product; or remove copyright notices. All rights not expressly granted stay with us and our licensors. We may end your license if you seriously breach these Terms.

4. Prices and payment

Prices are shown in US dollars and are one-time payments: there is no subscription and no recurring charge. Strikethrough prices show the regular price and the current launch discount. Visitors in some countries may see an approximate price in their local currency at checkout; the amount charged is shown before you pay. Payments are processed by Stripe; we never receive your full card number. Taxes may apply depending on your location. We may change prices or offers at any time, but changes do not affect orders already paid.

5. Delivery

After payment you are taken to a download page, and we email your download links to the address you used at checkout. Download links are personal and allow up to 15 downloads per file; if you need more, contact us. If you don't receive your email within an hour, check your spam folder or contact support@digitaldshop.com.

Updates. Any updates we release for the version you bought (VICE KIT 2.x) are included at no extra cost. We may, but don't have to, provide future major versions free of charge.

6. Refunds

Because the Products are digital and delivered immediately, all sales are final, except as described in our Refund Policy (for example duplicate charges, or files that don't work and we can't fix). When you buy, you ask us to deliver the digital content immediately and acknowledge that, once delivery starts, you lose any statutory right to withdraw or cancel where the law allows this. Nothing in these Terms removes rights you have under consumer law that can't be excluded.

7. Acceptable use

You agree not to misuse the Site, for example by trying to get Products without paying, interfering with the Site's security, scraping it, or using the Products to create content that is illegal, infringing, hateful or harassing. You are responsible for the content you create with the Products and for following the rules of the platforms you publish on (YouTube, Twitch, TikTok, Meta and others) and the terms of any game you capture.

8. Trademarks and third-party games

VICE KIT is an independent product. It is not affiliated with, endorsed or sponsored by Rockstar Games, Take-Two Interactive or any game publisher, or by Meta, Google, YouTube, Twitch, TikTok, OBS, Canva or CapCut. All third-party names and trademarks belong to their owners and are used only to describe compatibility. The Products do not include any game footage, logos or artwork owned by game publishers. When you use gameplay in your content, follow the publisher's video and content policies.

9. No guarantees of results

VICE KIT is a set of tools and templates. We do not guarantee any number of views, followers, subscribers, sponsorships or any income. Any examples, ideas, roadmaps or planners are for education and inspiration only and are not a promise of results. Your results depend on your content, effort, audience, platform algorithms and many other factors outside our control.

10. Disclaimers and limitation of liability

To the fullest extent the law allows, the Site and Products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the Products will be error-free or work with every device or third-party tool.

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Site or Products is limited to the amount you paid us for the Product in question. Some places don't allow these limitations, so they may not all apply to you.

You agree to indemnify us against claims arising from content you create with the Products or your breach of these Terms.

11. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve it informally within 30 days. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings there. If any part of these Terms is found unenforceable, the rest remains in effect. We may update these Terms; the version in effect when you bought applies to that purchase.
